As a follow up to the recommendations of the Intergovernmental Group of Expert on Competition Law and Policy at its sixth session in November 2004 UNCTAD organized two Voluntary Peer Reviews on Competition Law and Policy of Jamaica and Kenya. The two Voluntary Peer Reviews were held during the Fifth UN Conference on Competition held in Antalya (Turkey) from 14 to 18 November 2005. Related documents are available at the following links:

The UNCTAD Voluntary Peer Review on Competition Policy provides an opportunity to conduct an in-depth examination of the experience gained in the enforcement of competition policy in the selected country. The peer review process is conducted in several stages before the official presentation of the report by the consultant and an in-depth examination by the chair and two peer reviewers. This is followed by discussions in which officials from the institution that is being peer reviewed are given an opportunity to ask questions and clarify some of the recommendations. This is followed by a session in which both the reviewed country and other member countries, which are present, can exchange questions and answers on relevant issues arising from the Peer Review. The competition agency is requested to submit written comments and suggestions on the peer review report.

The peer review concludes with a discussion on the way forward and capacity building and technical assistance, which can be extended to the competition agency. For example, as a follow up to the recommendation of the Peer Review of Kenya, UNCTAD has launched a technical assistance project funded by UNDP Kenya. The project will assist the Monopolies and Prices Commission of Kenya in following up on the findings and the proposals made during the Peer Review. A similar project proposal has been made to assist the Jamaica Fair Trade Commission and submitted to the Inter American Development Bank and UNDP Jamaica for consideration.
